These General Terms and Conditions of Sale apply to the sale of cruise services offered by Nautic Experiences: sea cruises on ocean liners, private cruises on catamarans, sailboats, yachts or schooners, cabin cruises, and charters with or without skipper or crew.

Article 1 — Seller Identification

The site nautic-experiences.pro is operated by NAUTIC-EXPERIENCES, a trade name of KCOB SAS, with share capital of €8,130, registered with the Paris Trade and Companies Register under number 832 358 543, whose registered office is located at 1 Cour du Havre, 75008 Paris, France.

KCOB SAS is registered in the Register of Travel and Holiday Operators under number IM075250047.

Financial guarantee: Groupama Assurance-Crédit & Caution.

Professional liability insurance: Hiscox SA.

Article 2 — Purpose

These General Terms and Conditions of Sale govern the sale of cruise services offered by Nautic Experiences, including: sea cruises on ocean liners; private cruises on catamarans, sailboats, yachts or schooners; cabin cruises; charters with or without skipper or crew, as applicable.

Article 3 — Scope of Application

These Terms apply to any booking made with Nautic Experiences for services related to the cruise and travel business. They supplement the quote, commercial proposal, booking contract, and, where applicable, the specific conditions of the shipping companies, shipowners, or partners.

Article 4 — Pre-Contractual Information

Before the contract is concluded, the client receives essential information about the reserved service, including: the nature of the cruise; the dates and duration; the type of vessel; the cabin or boat category; services included and not included; the price; payment terms; and cancellation and modification conditions.

Article 5 — Formation of the Contract

The booking becomes firm and final after: written acceptance of the quote or proposal; signature of the contract or express validation of the booking; and payment of the requested deposit. Until these conditions are met, Nautic Experiences does not guarantee the availability of the service.

Article 6 — Price

Prices are expressed in euros, inclusive or exclusive of tax depending on the type of service and the client's status. Unless otherwise stated, the price includes only the services indicated in the quote or contract.

Unless expressly stated, the following are not included: transport to the point of embarkation; transfers; insurance; excursions; personal expenses; drinks; tips; onboard expenses; and local, port, or tourist taxes not mentioned as included.

Article 7 — Price Revision

The price may be revised in the event of variation in: the cost of transport or fuel; port taxes or fees; exchange rates where the service is exposed to them; or additional costs imposed by a supplier or competent authority. Any revision will be communicated to the client as soon as possible.

Article 8 — Payment Terms

Unless otherwise specified in the quote or contract: a deposit of 30% to 50% is required upon booking; the balance is payable no later than 45 days before departure. A specific payment schedule may apply for certain companies or shipowners, in which case this schedule prevails.

Any delay or default in payment authorizes Nautic Experiences to suspend or cancel the booking, at the client's expense, without prejudice to any additional claim.

Article 9 — Modifications Requested by the Client

Any request for modification after confirmation of the booking is subject to: feasibility; availability; agreement of the relevant service providers; and any administrative fees or charges invoiced by suppliers. No modification is guaranteed after confirmation.

Article 10 — Cancellation by the Client

Any cancellation must be notified in writing. Unless stricter specific conditions are imposed by the company, shipowner, or service provider, the following cancellation fees apply:

  • More than 90 days before departure: 30% of the total amount
  • 89 to 60 days: 50% of the total amount
  • 59 to 30 days: 70% of the total amount
  • Less than 30 days before departure: 100% of the total amount

Where a supplier's conditions impose higher fees, these apply as a priority if they have been brought to the client's attention.

Article 11 — Cancellation or Modification by Nautic Experiences

Nautic Experiences may modify or cancel a service in the event of: vessel unavailability; a decision by the carrier or shipowner; force majeure; exceptional and unavoidable circumstances; or safety conditions preventing normal performance of the service.

In this case, Nautic Experiences will offer, depending on the situation: a replacement service; a postponement; or a refund of the sums paid, excluding any additional compensation when the cancellation or modification results from a case of force majeure or a decision beyond its control.

Article 12 — Itinerary, Weather, and Navigation

The client acknowledges that all navigation is subject to weather conditions, sea conditions, the captain's decisions, and port and operational constraints. The itinerary, stopovers, schedules, embarkation or disembarkation ports, and certain activities may be modified for safety or operational reasons, without this automatically entitling the client to a refund.

Article 13 — Safety and Conduct on Board

The client and passengers agree to comply with safety instructions, onboard regulations, instructions from the captain and crew, and applicable regulations. Any person whose behavior is dangerous, aggressive, inappropriate, or incompatible with safety or the proper conduct of the service may be refused boarding or disembarked, without refund.

Article 14 — Administrative and Health Formalities

Each passenger is responsible for their travel documents, identity, the validity of their passport or ID card, visas, parental authorizations, certificates, and any health formalities. Any refusal of boarding, entry into a territory, or access to a service due to non-compliant documents will not give rise to a refund.

Article 15 — Insurance

Nautic Experiences has professional liability insurance and a financial guarantee in accordance with applicable regulations. Unless otherwise stated, cancellation, assistance, repatriation, baggage, or individual liability insurance is not included in the price. It is the client's responsibility to check their coverage and, if necessary, take out appropriate insurance.

Article 16 — Liability

Nautic Experiences is responsible for the proper performance of the services falling within the scope of its contract, in accordance with applicable legal provisions. However, its liability cannot be engaged in the event of: fault of the client; unforeseeable and insurmountable act of a third party; force majeure; exceptional and unavoidable circumstances; or a decision made by the captain or competent safety authorities.

In any event, Nautic Experiences' liability is limited to proven direct damages, excluding indirect damages, loss of business, loss of opportunity, or commercial prejudice.

Article 17 — Complaints

Any complaint must be reported as soon as possible during the service to allow, if possible, immediate handling. Any complaint must then be confirmed in writing within 8 days of the end of the service, accompanied by any relevant supporting documents.

Article 18 — Personal Data

Personal data collected as part of the booking is processed for the purposes of contract performance, customer relationship management, and administrative, accounting, and commercial management. It is processed in accordance with applicable personal data protection regulations.

Article 19 — No Right of Withdrawal

In accordance with applicable legal provisions, accommodation, transport, catering, or leisure services provided on a specific date or at a specific frequency are not subject to the right of withdrawal.

Article 20 — Applicable Law and Disputes

These Terms are governed by French law. In the event of a dispute, the parties will first seek an amicable solution. Failing an amicable agreement, the dispute will be brought before the competent courts under ordinary law rules.

These General Terms and Conditions of Sale govern nautical and river event services organized by Nautic Experiences on the water: events on barges; seminars, cocktails, evenings and conferences; boat or yacht privatization; events underway or docked; corporate operations, public relations, incentives, product launches; services with or without catering; services with or without accommodation.

Article 1 — Seller Identification

NAUTIC-EXPERIENCES is a trade name of KCOB SAS, registered with the Paris Trade and Companies Register under number 832 358 543, whose registered office is located at 1 Cour du Havre, 75008 Paris, France.

KCOB SAS is registered in the Register of Travel and Holiday Operators under number IM075250047 and holds a financial guarantee as well as professional liability insurance.

Article 2 — Purpose

These Terms govern event services organized by Nautic Experiences on the water, including: events on barges; seminars, cocktails, evenings and conferences; boat or yacht privatization; events underway or docked; corporate operations, public relations, incentives, product launches; services with or without catering; services with or without accommodation.

Article 3 — Nature of Services

Nautic Experiences may act as: organizer; intermediary; or in coordination with one or more service providers. Services may include: privatization of the boat or barge; crew; provision of spaces; catering; drinks; decoration; entertainment; sound, light, and video equipment; hospitality staff; navigation; and dockside services. Only services expressly mentioned in the quote or contract are included.

Article 4 — Quote and Formation of the Contract

Any request is subject to a quote or commercial proposal. The booking becomes firm after: written acceptance of the quote; signature of the contract or approval; and payment of the requested deposit. Booking options are valid for the period indicated on the quote. Beyond this, availability and rates may change.

Article 5 — Price

Prices are expressed in euros, inclusive or exclusive of tax as applicable. Unless otherwise stated, the price includes only the services referred to in the quote. Unless expressly stated, the following are not included: transport of participants; accommodation; insurance; services not described in the quote; additional consumption; overtime; fees related to late requests; and services from external providers not initially planned.

Article 6 — Payment Terms

Unless otherwise specified in the quote or contract: a 50% deposit is required upon booking; the balance is due 30 days before the event. Any unpaid amount due may result in suspension of services, cancellation of the booking, and late payment penalties in accordance with regulations applicable to professional clients.

Article 7 — Number of Participants

The number of participants communicated by the client determines, in particular, the capacity, vessel configuration, catering, technical needs, and administrative or operating permits. Any change in the number of participants must be notified no later than 7 days before the event. After this deadline, billing may be maintained based on the initially planned number or adjusted according to actual costs incurred.

Article 8 — Cancellation by the Client

Any cancellation must be notified in writing. The following cancellation fees apply:

  • More than 60 days before the event: 30% of the total amount
  • 59 to 30 days: 50% of the total amount
  • 29 to 15 days: 70% of the total amount
  • Less than 15 days before the event: 100% of the total amount

Any service already committed, ordered, or customized remains payable in full.

Article 9 — Modifications Requested by the Client

Any request to modify the content, format, location, number of participants, schedule, catering, entertainment, or technical setup may result in a new feasibility study, a price adjustment, additional fees, or a refusal if the request is incompatible with operational constraints.

Article 10 — Schedules and Participant Delays

The client is responsible for the punctuality of their guests, service providers, and participants. Any delay caused by the client or their participants cannot be attributed to Nautic Experiences or the vessel operator. In the event of a delay: departure may be postponed if possible; the duration of the service may be reduced; and the service will still be invoiced in full. Any authorized overtime may result in additional billing.

Article 11 — Weather Conditions and Navigation

Navigation depends on weather conditions, water levels, the state of the river or sea, operational constraints, and the captain's decision. In the event of unfavorable conditions, flooding, strong winds, administrative orders, port or river restrictions, or any safety constraints: navigation may be modified or cancelled; the route may be adapted; the event may be maintained dockside; and certain outdoor services may be cancelled or replaced. These adaptations do not constitute grounds for cancellation or refund as long as the main service can be maintained under reasonable conditions.

Article 12 — Safety and Authority on Board

Participants must comply with safety instructions, boat operating rules, and instructions from the captain, crew, and staff present. The captain or operator has authority on board for any safety-related matter. Any person exhibiting dangerous, aggressive, or safety-incompatible behavior may be refused boarding or excluded from the event, without refund.

Article 13 — Alcohol and Conduct

Alcohol consumption must remain compatible with safety, regulations, and the proper conduct of the service. Nautic Experiences, the captain, the operator, or the person in charge may refuse boarding, interrupt alcohol service, or end the participation of any person whose behavior is dangerous, aggressive, clearly inappropriate, or incompatible with the safety of persons and property. No refund can be requested in this case.

Article 14 — Maximum Capacity and Access Control

The maximum number of people authorized on board is set by regulations and by the boat operator. This number cannot be exceeded under any circumstances. Nautic Experiences or the operator reserves the right to refuse boarding of any additional person beyond the authorized capacity, without compensation.

Article 15 — DJ, Music, and Noise Regulations

Musical, dance, or sound-broadcasting events are subject to applicable regulations, site constraints, operator rules, and administrative limitations. Volume, broadcasting hours, or the nature of the equipment may be limited or stopped to comply with regulations, technical constraints, safety, neighboring residents, or requirements of competent authorities. The client agrees to comply with these limitations.

Article 16 — External Service Providers

Any external service provider brought by the client, such as a DJ, host, caterer, photographer, technician, artist, or decorator, must: be declared to Nautic Experiences in advance; comply with the safety rules of the venue and boat; hold the necessary insurance and permits; and operate within the technical and scheduling constraints communicated. Nautic Experiences cannot be held liable for services provided by these external parties.

Article 17 — Damage

The client is responsible for any damage caused by themselves, their guests, employees, participants, or service providers. Any damage to premises, furniture, installations, technical equipment, or the vessel will be subject to additional billing corresponding to the cost of repair, replacement cost, or any operating losses or immobilization costs invoiced by the operator.

Article 18 — Personal Belongings

Participants remain responsible for their personal belongings throughout the service. Nautic Experiences, the vessel operator, and service providers cannot be held liable for loss, theft, forgetting, or damage to personal items.

Article 19 — Non-Circumvention and Commercial Protection

The client acknowledges that Nautic Experiences makes available its network of partners, including shipowners, barge operators, boat owners or managers, companies, and nautical and event service providers.

The client agrees not to circumvent Nautic Experiences' involvement by contracting directly with a partner or service provider introduced by it, in order to avoid its intermediation or remuneration. This commitment applies throughout the business relationship and for a period of 24 months from the first quote, introduction, or proposal.

Any direct booking or contracting with a partner introduced by Nautic Experiences will be considered commercial circumvention. In this case, the client agrees to pay Nautic Experiences a fixed indemnity equal to 30% of the estimated amount of the circumvented service, without prejudice to any additional damages.

Article 20 — Confidentiality of Commercial Proposals

Quotes, concepts, programs, recommendations, commercial proposals, venue or boat selections, budgets, itineraries, and documents provided by Nautic Experiences are strictly confidential and remain the exclusive property of Nautic Experiences.

The client agrees not to: transmit them to third parties; reproduce them; use them without authorization; or use them to negotiate directly with a service provider introduced by Nautic Experiences. Any unauthorized use may give rise to compensation for damages suffered.

Article 21 — Image Rights and Communication

Unless the client objects in writing beforehand, Nautic Experiences may use, for commercial communication and promotional purposes, photographs or videos taken during events, provided this does not infringe on individuals' rights or confidential information. These elements may be used on the website, social media, commercial brochures, client references, and portfolio. The client may object in writing to any use before the event.

Article 22 — Variation in Operating Costs

When the service includes sea or river navigation, the price may be adjusted in the event of a significant variation in fuel prices, river, port, or administrative taxes, or operating costs imposed by an authority, operator, or supplier. Any variation will be communicated to the client as soon as possible.

Article 23 — Insurance

Nautic Experiences holds professional liability insurance and a financial guarantee in accordance with applicable regulations. The client is encouraged to take out any useful insurance, particularly regarding cancellation, organizer liability, property damage, participant coverage, and external service providers.

Article 24 — Liability

Nautic Experiences has an obligation of means in the organization and coordination of event services, unless otherwise required by mandatory legal provisions. Its liability cannot be engaged in the event of: fault of the client; conduct of a participant; failure of a service provider imposed by the client; force majeure; administrative or safety decisions; or operating constraints of the vessel or site.

In any event, its liability is limited to proven direct damages, excluding indirect damages, loss of image, loss of business, loss of revenue, or loss of opportunity.

Article 25 — Force Majeure

The following are considered cases of force majeure or exceptional circumstances, among others: bad weather; flooding; storms; navigation bans; administrative closures; strikes; labor disputes; major technical incidents; decisions by authorities; health measures; and events making normal performance of the service impossible or dangerous. These events may justify cancellation, modification, postponement, or adaptation of the service without additional compensation.

Article 26 — Complaints

Any difficulty must be reported without delay during the event so that a solution can be sought. Any complaint must then be confirmed in writing within 8 days of the date of the service, accompanied by the necessary supporting documents.

Article 27 — Personal Data

Data collected is processed for the purposes of organizing and managing the commercial, administrative, and contractual aspects of the service, in accordance with applicable regulations.

Article 28 — Applicable Law and Disputes

These Terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution. Failing this, the competent courts will be seized under ordinary law rules, and for professional clients, the court in the jurisdiction of KCOB SAS's registered office may be seized.
